  9. WinBench(tm) is the PC Magazine Windows Benchmark suite.  It provides 
  10. comprehensive graphics benchmark tests using the Windows Graphical Device 
  11. Interface (GDI) and selected high-level user interface functions. Version 3.1
  12. is the fourth major release of WinBench.  Version 3.1 adds tests of hard disk
  13. subsystems.

  15. Carefully read the Ziff-Davis Licensing Agreement in its entirety before using 
  16. this software.

  18. WinBench(tm), Graphics WINMARK(tm), Disk WINMARK(tm), and WINMARK(tm) are
  19. trademarks of the Ziff-Davis Publishing Co.

  21. The Compaq 386/25m used as a reference PC for the WINMARKs was configured
  22. with the Compaq QVision EISA graphic board.  The reference PC was tested with
  23. the Compaq QVISION.DRV driver at 800x600x256 colors under Windows 3.1.

  25. Ziff-Davis Licensing Agreement

  27. Read this agreement carefully before using the software.  By using this software
  28. you agree to be bound by the terms of this agreement.  If you do not agree to
  29. the terms of this agreement, promptly return the software and the accompanying
  30. items (including documentation and container) to PC Magazine Labs, 1 Park
  31. Avenue, New York, NY 10016.

  33. The software encoded on the diskettes or available through an online access
  34. service and related documentation represent one copy of WinBench(tm), an automated
  35. test tool used in the evaluation and measurement of Windows performance
  36. ("WinBench(tm)"), a proprietary product of Ziff-Davis Publishing Company, a 
  37. division of Ziff Communications Company ("Ziff-Davis"), which is protected by 
  38. the United States Copyright Act and international copyright treaty
  39. provisions.  Ziff-Davis retains ownership of the copyright to the materials.  
  40. The software encoded on the enclosed diskettes or available through an online access
  41. service and the related documentation are licensed (not sold) to you for use
  42. solely under the terms and conditions contained herein.

  44. GRANT OF LICENSE
  45.  
  46. Ziff-Davis grants you the non-transferrable right to use WinBench(tm) on a 
  47. single dedicated computer or a networked file server with multiple PCs solely 
  48. for internal use and evaluation purposes.  You may not rent, lease, sell,
  49. sublicense, assign, or otherwise transfer WinBench(tm) or the accompanying
  50. documentation. You may not reverse engineer, decompile, disassemble, modify, 
  51. or translate WinBench(tm), and all its supporting files or use WinBench(tm) 
  52. for any commercial purposes.  You may either (a) make one copy of WinBench(tm) 
  53. solely for backup or archival purposes, or (b) transfer a copy of WinBench(tm) 
  54. across a network to PCs attached to that network.  This license and your right 
  55. to use WinBench(tm) automatically terminate if you fail to comply with any 
  56. provision of this license.  Upon termination, you agree to destroy all copies 
  57. of WinBench(tm).

  59. CONFIDENTIALITY
  60.  
  61. Results of use or testing of WinBench(tm) are confidential and proprietary to 
  62. Ziff-Davis.  You agree not to provide the results of use or testing of 
  63. WinBench(tm) to any other party without Ziff-Davis' written permission.  
  64. Unauthorized use of WinBench(tm) may cause irreparable harm to Ziff-Davis.  
  65. You agree to promptly report any unauthorized use to Ziff-Davis.

  67. U.S. GOVERNMENT RESTRICTED RIGHTS
  68.  
  69. WinBench(tm) is provided with RESTRICTED RIGHTS.  Use, duplication, or 
  70. disclosure by the Government is subject to restrictions as set forth in 
  71. subparagraph (c) (1) (ii) of the Rights in Technical Data and Computer 
  72. Software Clause at DFARS 48 CFR 252.277-7013 for DoD contracts and 52.227-19 
  73. (a) through (d) for civilian agency contracts. Contractor/ manufacturer of

  78. WinBench(tm) IS PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND.  
  79. ZIFF-DAVIS MAKES NO WARRANTY OR REPRESENTATION, EITHER EXPRESS OR IMPLIED, 
  80. WITH RESPECT TO WinBench(tm), INCLUDING, BUT NOT LIMITED TO, PERFORMANCE, 
  81. MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE, AND ASSUMES NO
  82. RESPONSIBILITY FOR THE ACCURACY OR APPLICATION OF OR ERRORS OR OMISSIONS IN
  83. WinBench(tm).  THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF
  84. WinBench(tm) IS ASSUMED BY YOU.  THE WARRANTY AND REMEDIES SET FORTH ABOVE ARE
  85. EXCLUSIVE AND IN LIEU OF ALL OTHERS, ORAL OR WRITTEN, EXPRESS OR IMPLIED.  NO
  86. ZIFF-DAVIS DEALER, DISTRIBUTOR, AGENT OR EMPLOYEE IS AUTHORIZED TO MAKE ANY
  87. MODIFICATION OR ADDITION TO THIS WARRANTY.

  89. ZIFF-DAVIS WARRANTS THE ORIGINAL WinBench(tm) PHYSICAL DISKETTE AND PHYSICAL 
  90. DOCUMENTATION TO BE FREE OF DEFECTS IN MATERIALS AND WORKMANSHIP. IF 
  91. ZIFF-DAVIS RECEIVES NOTIFICATION OF DEFECTS IN MATERIALS OR WORKMANSHIP, AND 
  92. SUCH NOTIFICATION IS DETERMINED BY ZIFF-DAVIS TO BE CORRECT, ZIFF-DAVIS WILL 
  93. REPLACE THE DEFECTIVE DISKETTE OR DOCUMENTATION. THE ENTIRE AND EXCLUSIVE 
  94. LIABILITY AND REMEDY FOR BREACH OF THE LIMITED WARRANTY SHALL BE LIMITED TO 
  95. REPLACEMENT OF DEFECTIVE DISKETTE(S) OR DOCUMENTATION.  IN NO EVENT WILL 
  96. ZIFF-DAVIS BE LIABLE FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR 
  97. CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE WinBench(tm), 
  98. EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  SPECIFICALLY, ZIFF-DAVIS
  99. IS NOT RESPONSIBLE FOR ANY COSTS INCLUDING, BUT NOT LIMITED TO, THOSE INCURRED 
  100. AS A RESULT OF LOST PROFITS OR REVENUE, LOSS OF USE OF WinBench(tm), LOSS OF 
  101. DATA OR EQUIPMENT, THE COSTS OF RECOVERING SOFTWARE OR DATA OR EQUIPMENT, THE 
  102. COST OF SUBSTITUTE SOFTWARE OR DATA, CLAIMS BY THIRD PARTIES, OR FOR OTHER 
  103. SIMILAR COSTS. IN NO CASE SHALL THE LIABILITY OF ZIFF-DAVIS EXCEED THE AMOUNT 
  104. OF THE LICENSE FEE PAID FOR WinBench(tm).

  106. GENERAL
  107. Some states do not allow exclusion or limitation of implied warranties or
  108. limitation of liability for incidental or consequential damages; so the above
  109. limitations or exclusions may not apply to you.

  111. Ziff-Davis retains all rights not expressly granted.  Nothing in this license
  112. constitutes a waiver of the rights of Ziff-Davis under the U.S. Copyright Act 
  113. or any other Federal or state law.  You are responsible for installation,
  114. management, and operation of WinBench.  This Agreement and the limited warranty
  115. and limited liability contained herein shall be governed by the laws of the
  116. State of New York.

  118. What You Need to Run WinBench
  119.  
  120. To run WinBench, you need to have the following hardware and software.
  121.  
  122. WinBench requires:
  123.  
  124.     A PC that runs Windows 3.0 or 3.1
  125.  
  126.     About 250,000 bytes available on your hard disk for the WinBench
  127.     software itself.
  128.  
  129.     About 9 million bytes of available space on your hard disk for a
  130.     temporary file to run the WinBench disk tests, and to save the results
  131.     of any WinBench tests that you run.  If your hard disk does not have
  132.     enough space for the work file, WinBench will not run the hard disk
  133.     tests.
  134.  
  135.     MS-DOS Release 3.1 or later (Release 5.0 recommended)
  136.  
  137.     Microsoft Windows 3.0 or later (Release 3.1 or later recommended)

  139. Installing WinBench
  140.  
  141. WinBench is distributed as as single self-extracting executable file,
  142. WINB31.EXE, on a single diskette.  WINBENCH.EXE is the benchmark program
  143. itself.  WINBENCH.HLP is the on-line help for WinBench.  README.TXT is this
  144. file, an ASCII text file that describes how to install WinBench.

  146. You will probably want to create a directory that contains the WinBench files,
  147. and that will contain all of the report files generated by WinBench.  For
  148. example, you could use the following DOS commands to create the WinBench
  149. directory on your C: drive, and to change to that directory:

  151.     MD C:\WinBench
  152.     CD C:\WinBench
  153.  
  154. Then, execute the self-extracting WINB31 program to install all of the files
  155. from the WinBench diskette. If the WinBench diskette is in the A: drive of your
  156. PC, and you created the WinBench directory as shown above, do the following
  157. command:

  161. How to Use WinBench
  162.  
  163. You launch WinBench just like any other Windows application:

  165. 1.  After installing WinBench as shown above, you may execute the DOS
  166. command:

  168.     WIN WINBENCH

  170. 2. You may open up the file manager, go to the WinBench directory on your C:
  171. drive, and double-click on WINBENCH.EXE.
